SWEAT LAB STUDIO — TERMS & CONDITIONS
PART A - GENERAL STUDIO USE
DEFINITIONS
Class — A reformer Pilates or strength-based session conducted by Sweat Lab Studio.
Class Pack — A pre-purchased bundle of Classes as outlined in the Payments T&Cs.
Client, or you — Any person who books, purchases, or attends a Class or uses the facilities at Sweat Lab Studio.
Fees — The applicable fees payable by a Client for Classes, Memberships, or Class Packs, as displayed on the Mind Body platform from time to time.
Instructor — A person employed or engaged by Sweat Lab Studio to instruct Classes.
Membership — A recurring direct debit membership as outlined in the Payments T&Cs.
Mind Body — The third-party booking and payment platform used by Sweat Lab Studio to manage bookings and process payments.
Staff — Any person employed or engaged by Sweat Lab Studio, including Instructors.
Sweat Lab Studio, we, or us — Sweat Lab Studio trading as Sweat Lab Studio.
INTERPRETATION
• The singular includes its plural and vice versa.
• Headings are for convenience only and do not affect interpretation.
• A reference to dollars or $ is to Australian currency.
• A reference to legislation includes that legislation as amended or replaced from time to time.
• Words such as including or for example do not limit the meaning of the words preceding them.
1. Acceptance of Terms
1.1. By booking a Class, entering the studio, or using any Sweat Lab Studio facilities, you agree to be bound by these Terms and Conditions.
1.2. These Terms and Conditions apply to all Clients, guests, and visitors.
1.3. Sweat Lab Studio may amend these Terms and Conditions at any time by giving written notice to you or by publishing updated terms on the Mind Body platform. Your continued use of our services will be deemed acceptance of any such amendment.
2. Health & Medical Disclaimer
2.1. Participation in reformer Pilates and strength-based Classes is physically demanding. By attending, you confirm that:
(a) you are in good physical health and have no medical condition, injury, or disability that would prevent safe participation;
(b) you have consulted a qualified medical professional if you have any pre-existing conditions, injuries, recent surgery, or are pregnant;
(c) you will inform your Instructor of any health concerns, injuries, or physical limitations prior to each Class commencing; and
(d) you acknowledge that Sweat Lab Studio Instructors are not medical professionals and cannot provide medical advice.
2.2. If your health status changes between bookings, it is your responsibility to notify us before attending your next Class.
2.3. You must report any injury or accident sustained during a Class to a Staff member immediately.
3. Assumption of Risk & Liability
3.1. You warrant and represent to us that you are medically sound and fit to undertake physically demanding exercise and to use the equipment and facilities at Sweat Lab Studio.
3.2. You acknowledge and agree that you attend Classes and use Sweat Lab Studio equipment and facilities at your sole risk and responsibility, and that you are fully aware that Classes are physically demanding and could pose a risk to your health if you are not medically fit.
3.3. To the extent permitted by law, you unconditionally and irrevocably release Sweat Lab Studio, its owners, Staff, and Instructors from any liability, including in relation to any personal injury, illness, death, or loss or damage to personal property sustained during or in connection with your participation.
3.4. To the extent permitted by law, all implied warranties, guarantees, and terms are excluded, except where they cannot be excluded under the Australian Consumer Law. Where liability cannot be excluded, it is limited at Sweat Lab Studio's option to:
(a) in the case of goods, repair, resupply of equivalent goods, or refund; or
(b) in the case of services, re-performing the relevant services, or refund.
3.5. To the extent permitted by law, Sweat Lab Studio excludes any liability for indirect, special, or consequential loss or damage, including loss of opportunity, loss of profit, or any other losses not arising naturally from the relevant circumstances.
3.6. To the extent permitted by law, Sweat Lab Studio's aggregate maximum liability to a Client is limited to the Fees paid by that Client in the previous 6 months.
4. Bookings & Mind Body Platform
4.1. All Class bookings are managed through Mind Body. By registering and booking through Mind Body, you also agree to Mind Body's applicable terms of use. 4.2. It is your responsibility to:
(a) maintain accurate personal and contact details in your Mind Body account;
(b) book into the correct Class type suited to your experience level; and
(c) check your booking confirmation and any pre-Class communications from Sweat Lab Studio.
4.3. Bookings are subject to availability at the discretion of Sweat Lab Studio.
4.4. Classes booked by a Client are not transferable to another person and cannot under any circumstances be used by anyone other than the Client who made the booking.
4.5. Sweat Lab Studio reserves the right to refuse entry or remove a Client from a Class if, in our reasonable assessment, participation poses a risk to that individual or others.
5. Code of Conduct
5.1. You must comply with this Code of Conduct at all times while at Sweat Lab Studio. You agree that you must:
(a) use all equipment with care and only as instructed by Staff;
(b) respect and follow all directions given by Staff at all times;
(c) act in a safe, hygienic, appropriate, and lawful manner;
(d) treat all Staff and fellow Clients with courtesy and respect;
(e) not cause any loss or damage to any property of Sweat Lab Studio or any other person;
(f) not disrupt or interfere with Classes or other Clients in any way;
(g) refrain from using mobile phones during Classes;
(h) avoid wearing strong fragrances out of consideration for others;
(i) not consume alcohol or smoke cigarettes or vapes on the premises;
(j) not use camera or audio recording devices at Sweat Lab Studio withoutprior written consent from management; and
(k) immediately provide confirmation of your booking if requested by a Staff member.
5.2. Sweat Lab Studio reserves the right to ask any Client to leave the studio if their behaviour is deemed disruptive, unsafe, or disrespectful. Repeated breaches may result in termination of Membership or access.
6. Age Policy — No Children
6.1. No person under the age of 16 years is permitted to enter the studio at any time, including as a guest or visitor.
6.2. Clients between the ages of 16 and 17 years may be eligible to participate in Classes provided that:
(a) written consent is provided by the minor's parent or legal guardian prior to their first Class; and
(b) the minor complies with all safety requirements and directions from Staff at all times.
6.3. Children are not permitted in the studio under any circumstances, including in waiting areas or reception. Clients are asked to make alternative arrangements for the care of children prior to attending.
6.4. Sweat Lab Studio accepts no responsibility or liability for any unsupervised minors on the premises.
7. Studio Etiquette & Class Entry
7.1. Clients are asked to arrive on time for their Class. Latecomers may not be admitted to Class to avoid disruption or safety risk, and their Class credit will not be refunded.
7.2. The warm-up at the start of each Class is an important component for your safety. If you arrive more than 5 minutes late or are unable to complete the warm-up, the Instructor may, at their discretion, refuse your participation.
7.3. Grip socks are mandatory for all reformer Classes and must be worn at all times on the equipment. Grip socks are available for purchase at the studio.
7.4. Comfortable, form-fitting activewear is recommended. Street shoes are not permitted on the studio floor.
7.5. You must not use reformer equipment or any other studio equipment without Instructor supervision.
7.6. Any damage to equipment caused by negligent or inappropriate use may be charged to the responsible Client.
7.7. Please report any equipment faults or concerns to a Staff member immediately.
8. Personal Belongings
8.1. Sweat Lab Studio takes no responsibility for the loss, theft, or damage of personal belongings brought onto the premises.
8.2. Please leave valuables at home. Any storage facilities provided are used at your own risk.
8.3. Bags are not permitted on the studio floor for safety reasons.
8.4. Any lost property found must be handed to a Staff member immediately. Lost property will be held for a reasonable period before being donated to charity.
9. Photography, Filming & CCTV
9.1. Photography and filming within the studio by Clients is not permitted without prior written consent from Sweat Lab Studio management, and must not capture other Clients without their explicit permission.
9.2. Sweat Lab Studio may photograph or film Classes for marketing and promotional purposes. Please notify us in writing if you do not wish to be included.
9.3. Sweat Lab Studio premises may be monitored by closed-circuit television (CCTV) at all times for security purposes.
10. Privacy
10.1. Your personal information is collected and handled in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.
10.2. We collect your information for the purposes of managing your bookings, communicating with you, and providing our services. We will not share your information with third parties except as required to operate our booking platform or as required by law.
11. Force Majeure
11.1. Sweat Lab Studio's obligations under these Terms and Conditions will be suspended during the time and to the extent that we are prevented from or delayed in complying with those obligations by an event of Force Majeure.
11.2. Force Majeure means any event or circumstance beyond the reasonable control of Sweat Lab Studio, including pandemics or epidemics, acts of God, fire, flood, natural disaster, government restrictions or directions, civil disorder, strikes, or failures by third-party suppliers.
12. Governing Law
12.1. These Terms and Conditions are governed by the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland.
